V-TEL PREPAID PHONE CARDS TERMS AND CONDITIONS In these terms "We", "us", "The Company", "V-Tel" all refer to V-Tel Cards division of Dhanus Technologies Ltd unless the context is repugnant to such a meaning. "You", "User", "Customer" shall all refer to a customer who has purchased a V-Tel prepaid phone card either from us or from any of our duly authorized agents. "You" may also refer to any user of the V-Tel card whether such a person purchased the card from us or not. I USAGE 1. Unless otherwise specified, all prepaid phone card usage is deducted in whole minute increments. Partial minutes are rounded up to the next whole minute. 2. Until the full amount of the card is exhausted, the per-minute cost of a call will be deducted on a real-time basis as the prepaid phone card is used. 3. All calls for which we receive answer supervision shall incur a minimum one-minute charge. V-Tel relies on answer supervision to determine whether and when a call has been answered. Answer supervision is a signal sent by the carrier connecting the call to indicate the start of call. Answer supervision is generally received when a call is answered; however, answer supervision may also be generated by voicemail systems, private branch exchanges, and interexchange switching equipment. Where no answer supervision is received, we will commence billing forty (40) seconds following dial time unless the caller has terminated the call. 4. You will be told your balance available, on you dialing the destination. No other form of notification is given regarding the exhaustion of your prepaid phone card balance. II RATES 5. The rates are internally calculated in US Dollars and balance always announced in minutes. 6. The rates mentioned in www.v-tel.com/rates are subject to change without notice. III. COVERAGE 7. The countries where your V-Tel card works is printed on your card along with either a toll free or local access number. In some countries where multiple operators exist there may be more than one operator listed along with the access number it is up to the customer to call the correct operator based on the phone being used. 8. The following types of calls may not be completed with a prepaid phone card: calls to special numbers such as 700, 900 and toll free numbers; calls to Directory Assistance; operator assistance calls and calls requiring time and/or charges. 9. Calls placed from a rotary phone will default to a V-Tel operator or Voice Response Unit for call dialing only. IV Recharge Feature 10. Some prepaid phone cards are rechargeable. If applicable, recharge instructions are printed on the prepaid card packaging. V Terms and Conditions on a V-Tel Prepaid Phone Card 11. International rates vary. Partial minutes are rounded up to the next whole minute. 12. Use of card is your agreement to the rates, terms and conditions of service. 13. Payphone surcharge will apply. 14. Card expiration date is listed on card back. 15. Customer has the right to contact their State Public Utility Commission. 16. V-Tel is not responsible for loss, theft or unauthorized use of this card. For more countries than those listed please call 24-hour V-Tel Customer Service. 17. Some countries do not permit prepaid phone card usage, please call Customer Service for more information. 18. Card is not designed for use with wireless or cellular phones. Toll free access may not be toll free if used with wireless or cellular phones. 19. No cash redemption value. 20. V-Tel Cards are Non-refundable and Non-Transferable. 21. Payphone surcharge subject to change without notice. VI V-Tel Warranty 22. V-Tel makes no warranty, express or implied, regarding the conditions or fitness of the services offered for any particular use or purpose. The liability of V-Tel or any of V-Tel's agents, service providers or employees arising out of or in connection with the service will be limited to an amount equal to the charge for the service. In no event will V-Tel, it's employees, agents or service providers be liable for any punitive, special, indirect or consequential damages for any cause of action, whether in contract, tort, or otherwise and whether or not a party was or should have been aware of the possibility of these damages. VII Other Terms and Conditions 23. Other Terms and Conditions for use in specific countries may apply. 24. V-Tel reserves the right to change any terms or conditions without notice. VIII GOVERNING LAW; JURISDICTION 25. These Terms of Use shall be governed and construed in accordance with the laws of the State of California. You agree that in any legal action or proceeding between you and Dhanus for any purpose concerning this Agreement, you agree to submit to exclusive jurisdiction the state and federal courts of California and you expressly waive all defenses to jurisdiction. Any cause of action or claim you may have with respect to the Site, Services or Materials must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. V-Tel's failure to insist upon or enforce strict performance of any provision of these Terms of Use shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of these Terms of Use.
